Charges dropped against teacher accused of raping boy
No comment from prosecutors; Judge says they can refile case against Holly Bauer
NORWALK — Prosecutors may have dodged a bullet on Monday when a judge ruled to dismiss rape and sexual battery charges against a former Monroeville Schools teacher accused of repeatedly raping a 14-year-old boy.
Holly Bauer, 42, through her defense counsel James McGookey, asked Huron County Common Pleas Judge James Conway to dismiss the charges “with prejudice,” which would have stopped prosecutors from refiling the case.
McGookey wanted it dropped forever.
In a court filing, he told the court the prosecution trampled Bauer’s constitutional rights by using her compelled “Garrity” interview — statements given under the threat of losing her job — to build the indictment. A hearing on that question already was on the calendar to decide the issue, he said, telling Conway he believed he would win the argument.
